Schellhammer Estates respects your privacy. This policy explains how personal information is used when you browse our website, enquire about a property, request a valuation, or contact us.
1. Who is responsible for your information?
The data controller is Schellhammer Brokerage, S.L., operating the Schellhammer Estates real estate service, tax identification number (NIF) B93210375. Registered address: Centro Comercial San Roque Club, Local 3D, 11360 San Roque, Cádiz, Spain.
For privacy enquiries or to exercise your data-protection rights, please use our contact page or write to the registered address above. Our property office is located at Avenida de la Marina 2, 11310 Sotogrande, Cádiz, Spain.
2. Information we collect
When you contact us, we may process your name, email address, telephone number (where provided), message, property reference, the page you enquired from, and related correspondence. We may also receive information you choose to share by WhatsApp or telephone. For security and website operation, technical information such as IP address, browser details and timestamps may be processed by our hosting and security providers.
3. Why we use your information
We use enquiry details to respond to your request, supply relevant property information, arrange viewings, discuss valuations or property services, and maintain an appropriate record of our correspondence. Depending on the request, the legal basis is taking steps at your request before a contract (Article 6(1)(b) GDPR) or our legitimate interest in responding to enquiries and managing our business (Article 6(1)(f) GDPR). Where legal duties arise during a transaction, processing may also be necessary to comply with the law (Article 6(1)(c) GDPR).
We do not add you to marketing lists simply because you submit a property enquiry. Any optional promotional communications requiring consent will be sent only where a valid legal basis exists; you may withdraw consent at any time.
4. Website analytics, advertising and security
Our website uses privacy and security tools, including Cloudflare Turnstile to help distinguish legitimate form submissions from automated abuse. Turnstile may process technical data needed for its security checks. Google Analytics and Google Ads may be used to understand website visits and advertising interactions, subject to the choices available in our cookie-consent controls. Non-essential tracking is governed by your consent preferences where required. You can change those preferences using the website’s cookie controls.
5. Who receives information
Authorised staff and service providers assisting us with website hosting, email delivery, site security, customer communication and property enquiries may process information as necessary. Where relevant to your request, we may share enquiry information with a property owner or collaborating property professional to arrange a viewing or facilitate the requested service. We do not sell enquiry contact details to third-party marketers. Personal data may be disclosed where legally required.
Some technology providers may process data outside the European Economic Area. Where such transfers occur, applicable safeguards, including adequacy decisions or standard contractual clauses, are used as required by law. If you choose WhatsApp, your use of that service is also subject to its own privacy terms.
6. How long we keep it
We keep enquiry information for the time reasonably required to respond, manage follow-up communications and any related property relationship, then review and delete it when no longer needed, except where a longer period is required by law or to establish, exercise or defend legal claims. Accounting and transaction records may be retained for the relevant statutory periods.
7. Your rights
Subject to applicable law, you can request access to your personal information, correction, deletion, restriction of processing, data portability where applicable, or object to processing based on legitimate interests. You may withdraw consent without affecting processing carried out before withdrawal. Contact us via the contact page or registered postal address to make a request.
If you believe your personal data have been mishandled, you may lodge a complaint with the Agencia Española de Protección de Datos (AEPD).
8. Changes to this policy
We may update this policy to reflect changes to our services, suppliers or legal obligations. The current version will be published here with its latest revision date.
